New Fidic Red Book Pdf - A Guide to the 2017 Edition of the Construction Contract
The FÃdÃration Internationale des IngÃnieurs-Conseils (FIDIC) is an international association of consulting engineers that publishes standard forms of contract for various types of construction and engineering projects. One of the most widely used FIDIC contracts is the Conditions of Contract for Construction, also known as the Red Book, which is suitable for building and engineering works designed by the employer.
In 2017, FIDIC published a second edition of the Red Book, updating the previous version that was issued in 1999. The new edition aims to reflect the current best practices and address some of the common issues and challenges faced by the parties in the construction industry. Some of the main features and changes introduced by the 2017 Red Book are:
Greater detail and clarity on the requirements for notices and other communications, including time limits, formats and methods of delivery.
Separate provisions for employer's claims and contractor's claims, with a clear distinction between claims for additional payment or time and disputes arising from such claims.
Mechanisms for dispute avoidance, such as an enhanced role of the engineer in providing determinations and facilitating amicable settlements, and a new procedure for dispute adjudication/avoidance by a standing or ad hoc dispute board.
Detailed provisions for quality management, including obligations for the contractor to prepare and implement a quality management system and a quality assurance plan, and for the engineer to verify the contractor's compliance with these requirements.
Revised allocation of risks and liabilities between the employer and the contractor, such as a new exception to the contractor's responsibility for unforeseeable physical conditions, a new ground for termination by either party in case of prolonged suspension of works, and a new limitation of liability clause.
The 2017 Red Book also includes guidance notes for the preparation of particular conditions and forms of letter of tender, letter of acceptance, contract agreement and dispute adjudication/avoidance agreement. These documents are intended to assist the parties in adapting the general conditions to suit their specific needs and circumstances.
The 2017 Red Book is available in hardcopy or electronic format from the FIDIC website[^1^] [^2^]. A free download of amendments made in November 2022 is also provided[^2^]. The amendments mainly clarify some ambiguities and inconsistencies in the original text, without altering its substance or intent. The amendments also introduce a set of golden principles that should be respected by the parties when modifying or amending the general conditions.
The 2017 Red Book is expected to become a widely used standard form of contract for construction projects around the world. It offers a balanced and comprehensive framework for managing complex and challenging projects, while promoting good communication, cooperation and dispute resolution among the parties. 061ffe29dd
